Terms of Service

Torrent Ammunition offers some products that may be restricted by Federal, State and/or Local laws. We do not authorize the right to purchase any products that may be restricted in your area.

You must be at least 21 years of age to purchase handgun ammunition and at leat 18 years of age to purchase rifle ammunition. You must be at least 21 years of age to puchase other certain products such as black and smokeless powder products, guns, knives or reloading components. Under Federal law 18 U.S.C. 922(D)(1)-(9), persons with a legal disability are also restricted from purchasing certain products. Know your local laws and regulations prior to purchasing a product from Torrent Ammunition.

When you purchase any of our products, you accept full responsibility to comply with all regulations that apply. You also warrant that you have read this information, are an adult and have no legal disability that would preclude you from purchasing restricted items. Please check your local laws before ordering.

These commodities, technology or software should only be exported from the United States in accordance with the Bureau of Industry and Security Regulations (BIS). Diversion contrary to U.S. law is prohibited. Please contact BIS for regulatory information prior to shipment outside of U.S. Further, under Federal Law (the Arms Export Control Act – AECA and International Traffic in Arms Regulations – ITAR), it is unlawful and illegal to export defense items without a U.S. State Department-issued license. See e.g. ITAR Section 121.1 Categories I to III.

Some of the products in our offering contain lead. Lead is known to the State of California to cause cancer, birth defects or other reproductive harm.

Sales Tax

Torrent Ammunition charges applicable state and local sales taxes in states in which Torrent Ammunition has an obligation to collect such taxes. We follow the rules of each state based on the shipping address where the order is to be received.

If tax is not collected on your order, your purchase may be subject to use tax in your state unless your purchase is exempt from taxation or your state does not impose sales and use tax. Your purchase is not exempt merely because it is made over the Internet, by catalog, or by other remote means. States that impose sales taxes require purchases to report all purchases of tangible personal property or other taxable goods and services that are not taxed by the retailer and pay use tax on those purchases unless exempt under your state’s law. Many states allow you to report and pay use tax on your state individual income tax return or by filing a use tax return with your state tax administrator. These forms and corresponding instructions may be found on your state tax administrator’s website.

For tax-exempt Customers, Torrent Ammunition must have a copy of your state’s Sales/Use Tax Exemption paperwork on file before you place your order, otherwise, where applicable, we are required to collect sales tax at the tax rate effective at the time the order is processed. Unfortunately, we cannot refund sales tax collected on sales prior to receiving the signed Sales/Use Tax Exemption form(s).

Terms of Sale

PLEASE READ THESE TERMS OF SALE CAREFULLY. BY PURCHASING ANY PRODUCTS PROVIDED BY TORRENT AMMUNITION, OR OUR SUBSIDIARIES OR AFFILIATED COMPANIES, YOU AGREE TO BE BOUND BY THESE TERMS OF SALE AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF SALE, DO NOT MAKE ANY PURCHASES THROUGH OUR WEB SITE.

Torrent Ammunition (collectively, “Torrent Ammunition” or “we“), may make products available to you for purchase through our website (the “Site“). Your purchase of any products through the Site is governed by these Terms of Sale (“Terms of Sale“) and our site Terms of Service and are incorporated herein by reference. Terms with their initial letters capitalized and not otherwise defined in these Terms of Sale will have the meaning given to them in our site Terms of Service.

We reserve the right to change these Terms of Sale at any time and in our sole discretion. These changes will not apply to products you have already purchased, but your continued purchase of products through the Site will confirm your acceptance of such changes. We encourage you to frequently review these Terms of Sale prior to making any purchase through the Site to ensure you understand the terms and conditions that apply to your purchase of products through the Site. If you do not agree to the amended Terms of Sale, you must stop purchasing products through the Site.

Torrent Ammunition is an internet retailer engaged in selling products to our end Customers.  We are not a distributor and have agreements in place with several of our suppliers which prohibit the sale of their products for the purpose of resale, therefore orders we deem to be intended for resale may be rejected.  Accounts believed to be operating as resellers may also be restricted.

1 Pricing; Availability; Taxes

All prices are shown in U.S. dollars (except where otherwise noted) and taxes, shipping and handling charges are additional. All items are subject to availability, and we reserve the right to impose quantity limits on any order, to reject all or any part of an order and to discontinue products without notice, even if you have already placed your order. A product appearing on the Site does not guarantee that product’s stock or availability. In some cases, we may have to cancel a placed order when we determine a product is no longer available. All prices are subject to change without notice, and you agree that taxes may be adjusted from the amount shown on the payment checkout screens. Several factors may cause this adjustment, such as variances between processor programs and changes in tax rates.

You will be responsible for any applicable sales or use taxes, duties or other governmental taxes or fees payable in connection with your purchase. If you do not pay such taxes or fees in connection with a transaction, you will be responsible for such taxes or fees in the event that they are later determined to be payable. Torrent Ammunition reserves the right to collect such taxes or other fees from you at any time.

2 Errors

We attempt to be as accurate as possible and to eliminate errors on the Site; however, we do not represent or warrant that any product, service, description, photograph, pricing or other information is accurate, complete, reliable, current or error-free. In the event of an error, whether on the Site, in an order confirmation, in processing an order, when delivering a product or service or otherwise, we reserve the right to correct such error and revise your order accordingly (including charging the correct price) or to cancel the order and refund any amount charged. Your sole remedy in the event of an error is to cancel your order and obtain a refund.

3 Pre-Orders

We may offer you the ability to pre-order a product before it becomes available. If you choose to pre-order a product, we will not charge you until the product becomes available and we can ship your order.

4 Out-of-Stock Items

If the color, size or other features of a product you would like to purchase is not shown, or is not selectable, in the relevant drop-down box or list of options on the product’s information page, then the color, size or other features is not available for purchase. In the event that the specific product that you would like to purchase is unavailable, please check our Site at a later time as our inventory of products is subject to change.

5 Shipping & Handling

You agree to pay all shipping and handling charges shown to you at the time you place your order. We reserve the right to increase, decrease, add or eliminate these charges from time to time, and you agree to check all charges prior to placing an order. In general, we ship all products by economy ground delivery, which may be provided by any number of shipping service providers, unless otherwise indicated on the applicable product page or otherwise directed by you. Shipping and handling charges displayed during the checkout process may or may not reflect actual costs. All orders placed through the Site are shipment contracts, not destination contracts. Any shipping or delivery dates or times shown on the Site are estimates only and actual delivery dates and times may vary. We are not liable for any claims or damages resulting from any delays to your receipt of goods. You will not obtain or direct shipment of any product purchased through the Site for export.

6 Firearm Sales

Notwithstanding anything in this Agreement to the contrary, any purchase of a shotgun, handgun or rifle (each a “Firearm” and collectively “Firearms”) through the Site are subject to the terms and conditions of this Section 6. You must be 18 years old to purchase rifles and shotguns, and 21 years old to purchase handguns from Torrent Ammunition. Firearm orders cannot be changed or cancelled after they are placed.

All firearms are shipped to a Federal Firearms Licensed dealer (“FFL”) on your behalf. You may pick up your Firearm at such FFL only if you pass a National Instant Criminal Background Check conducted at the FFL at the time of pickup. The applicable FFL may charge you an additional transfer fee for their services. Due to shipping restrictions, Firearms cannot be returned to Torrent Ammunition. By ordering a Firearm, you certify you are the actual transferee/buyer of the Firearm, are of legal age and satisfy all federal, state and local legal/regulatory requirements to purchase this Firearm.

7 Payment; Credit for Refunds

Only valid credit cards and other payment methods acceptable to us may be used to purchase products through the Site. By submitting an order through the Site, you represent and warrant that you are authorized to use the designated credit card or other payment method and authorize us to charge that card or other payment method for the purchase amount of your order (including taxes, shipping, handling and any other amounts described on the Site). When you provide your payment information, you authorize us (or a third party service provider working on our behalf) to process and store your payment and other related information. If the credit card or other payment method you designate cannot be verified, is invalid or is not otherwise acceptable, we may suspend or cancel your order automatically at any time. You are responsible for resolving any problem we encounter in order to proceed with your order.

8 Returns, Exchanges & Refunds

All ammunition sales are final. Returns, refunds and exchanges will not be accepted by Torrent Ammunition except under certain conditions including but not limited to; insufficient inventory in stock to fulfill an order, an order placed by someone who we determine not to be lawfully eligible to purchase ammunition dictated by either age or shipping location, or any order which Torrent Ammunition deems necessary to cancel and refund the customer.  Notwithstanding anything to the contrary in this Agreement or with respect to any Torrent Ammunition warranty policy, you may not return purchased Firearms.

9 Complaints and Legal Notices

10 Limited Warranty

Certain manufacturers may offer a limited warranty on their products, and any such warranty is offered solely through the applicable manufacturer and not by Torrent Ammunition. Any claim made for a breach of that warranty must be made through the manufacturer. OTHER THAN PROVIDED IN THIS SECTION 10 AND ANY MANUFACTURER’S STANDARD WARRANTY APPLICABLE TO ANY PRODUCT, ALL PRODUCTS MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND TORRENT AMMUNITION, ON BEHALF OF ITSELF AND ITS LICENSORS AND SUPPLIERS, DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE CANNOT GUARANTEE AND DO NOT PROMISE ANY SPECIFIC RESULTS FROM THE USE OF PRODUCTS.

This warranty gives you specific legal rights, and you may have other rights, which vary from state to state. Some states do not allow us to disclaim certain warranties or to place limitations on how long an implied warranty lasts, so some or all of the limitations and disclaimers set forth in this section may not apply to you.

Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by Torrent Ammunition.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TORRENT AMMUNITION BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF BUSINESS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, NOR SHALL THE AGGREGATE LIABILITY OF TORRENT AMMUNITION, REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR STRICT LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OF SALE OR THE PURCHASE OR USE OF ANY PRODUCTS PURCHASED THROUGH THE SITE EXCEED THE PURCHASE PRICE OF THE PRODUCT OR SERVICE. TORRENT AMMUNITION IS NOT LIABLE FOR ANY HARM, BODILY INJURY, OR DAMAGE TO PROPERTY AS A RESULT OF THE PURCHASE AND/OR USE OF OUR PRODUCTS.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

12 Arbitration

PLEASE READ THE FOLLOWING PARAGRAPH CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE DISPUTES WITH TORRENT AMMUNITION AND IT LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.

You and Torrent Ammunition agree to arbitrate any dispute arising from these Terms of Sale or the sale and purchase of products from Torrent Ammunition in accordance with the Terms of Service pertaining to “Dispute Resolution and Binding Arbitration”, except that you and Torrent Ammunition are NOT required to arbitrate any dispute in which either party seeks equitable or other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets or patents. PLEASE READ THE TERMS OF SERVICE CAREFULLY, AS ARBITRATION PREVENTS YOU FROM SUING IN COURT OR FROM HAVING A JURY TRIAL.

13 Severability

If any provision of these Terms of Sale shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Sale and shall not affect the validity and enforceability of any remaining provisions.

Shipping Policy

Torrent Ammunition will only ship to customers within the contiguous United States of America. Torrent Ammunition will not ship ammunition or firearms to the States of California, Connecticut, Hawaii, Massachusetts, Illinois, New Jersey, Washington DC, or New York. Know your local laws and regulations. We will not ship ammunition to a P.O. Box.

APO/FPO Addresses

Due to shipping restrictions, Torrent Ammunition is not able to ship to APO/FPO addresses. If you would like to receive our products we can ship to a stateside military base (or other address) that is not an APO/FPO address.

International Orders

Due to the variety of regulations controlling shipments outside the U.S., Torrent Ammunition is unable to process international orders.

Hazardous Materials (HazMat) Fees / Charges

Smokeless Powder and Primers ship from our warehouse with other products. This ensures no more than one Shipping Charge and one HazMat Charge per order (unless you also order products that Ship Separately from Torrent Ammunition or our Suppliers and Oversized product charges still apply). Each order is limited to no more than 66 pounds of Smokeless Powder and Primers combined. Smokeless Powder and Primers are considered hazardous materials, incur HazMat Charges, and can only ship ground freight within the continental U.S. Due to safety considerations and legal/regulatory reasons, Smokeless Powder and Primers cannot be returned.

For all products incurring a HazMat fee, the product detail page will indicate hazardous products. Applicable fees will also be communicated in your Cart and within the Checkout process.

Federal Magazine and Ammunition Shipping Restrictions

18 USC § 922
(g) It shall be unlawful for any person–
(1) who has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year;
(2) who is a fugitive from justice;
(3) who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802));
(4) who has been adjudicated as a mental defective or who has been committed to a mental institution;
(5) who, being an alien–
(A) is illegally or unlawfully in the United States; or
(B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)));
(6) who has been discharged from the Armed Forces under dishonorable conditions;
(7) who, having been a citizen of the United States has renounced his citizenship;
(8) who is subject to a court order that–
(A) was issued after a hearing of which such person received actual notice, and at which such person had an opportunity to participate;
(B) restrains such person from harassing, stalking, or threatening an intimate partner of such person or child of such intimate partner or person, or engaging in other conduct that would place an intimate partner in reasonable fear of bodily injury to the partner or child; and
(C)
(i) includes a finding that such person represents a credible threat to the physical safety of such intimate partner or child; or
(ii) by its terms explicitly prohibits the use, attempted use, or threatened use of physical force against such intimate partner or child that would reasonably be expected to cause bodily injury; or
(9) who has been convicted in any court of a misdemeanor crime of domestic violence, to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.
(n) It shall be unlawful for any person who is under indictment for a crime punishable by imprisonment for a term exceeding one year to ship or transport in interstate or foreign commerce any firearm or ammunition or receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.

This Privacy Notice explains how Torrent Ammunition collects, uses and discloses information about you when you visit or conduct transactions through our websites, and other online products and services (collectively, the “Services“) or when you otherwise interact with us, such as via email. By visiting TorrentAmmunition.com or otherwise using our Services, you are accepting the practices we describe in this Privacy Notice.

We may change this Privacy Notice from time to time.  If we make changes, we will notify you by revising the date at the top of the notice and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification). WHAT INFORMATION DOES TORRENT AMMUNITION COLLECT?

Information You Give Us

We collect information you provide directly to us.  For example, we collect information when you create an account, participate in any interactive features of the Services, fill out a form or survey, leave a product review, participate in a contest or promotion, make a purchase, apply for a job, communicate with us via third party social media sites, request customer support or otherwise communicate with us.  The types of information we may collect include your name, email address, postal address, phone number, fax number, credit card information and any other information you choose to provide.

When we say “Personal Information” we mean any information that identifies an individual, such as (but not limited to) an individual’s name, email address, postal address, device-specific information, and log information (as described below). Any information that does not, on its own, identify an individual person is considered and treated as non-personal information. When non-personal information is combined with other information so that it does identify an individual, this information is treated as Personal Information. Torrent Ammunition does not and will not sell personal information.

Usage Information

We collect information about your use of the Services, such as the search terms you enter, your purchase history and invoice data.

Automatically Collected Information

When you access or use our Services, we also automatically collect information about you, including:

  • Log Information:  We collect log information about your use of the Services, including the type of browser you use, app version, access times, pages viewed, your IP address and the page you visited before navigating to our Services.
  • Device Information:  We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

WITH WHOM DOES TORRENT AMMUNITION SHARE YOUR PERSONAL INFORMATION?

We only share your Personal Information as described below

  • We work with third-party service providers who perform certain services on our behalf, such as vendors who provide customer service, deliver your orders, handle user reviews, provide us with analytics data concerning our Service, provide marketing assistance, remove repetitive information from customer lists, provide search results and links, process credit card payments. We may provide them with your Personal Information but only so that they can provide us with their services;
  • We may disclose your Personal Information if requested or required by law enforcement, legal process, or government authorities, but we will do so in accordance with applicable law;
  • We may provide your Personal Information if we believe your actions are inconsistent with our user agreements or policies, or as we reasonably deem necessary to protect the rights, property and safety of Torrent Ammunition or others, which may include sharing information with other companies for purposes of fraud protection or investigating or preventing illegal activities;
  • As part of our business, we may sell or buy other companies or business units, enter into financing transactions, sell company assets, consolidate or merge with other companies. We may be sharing or disclosing your Personal Information in connection with, or during negotiations of, any of these types of business activities;
  • We may disclose your Personal Information to our current and future parents, affiliates, subsidiaries and other companies under common control and ownership; and
  • With your consent or at your direction.

We may also share aggregated or de-identified information, which cannot reasonably be used to identify you. For example, we may share a hashed version of your email address to facilitate customized ad campaigns on other platforms.

SOCIAL SHARING FEATURES

The Services may offer social sharing features and other integrated tools (such as the Facebook “Like” button), [which let you share actions you take on our Services with other media, and vice versa].  Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. HOW LONG DO WE RETAIN YOUR DATA?

The time periods for which we retain your Personal Information will depend on the purposes for which we use it. We will retain your Personal Information for as long as is necessary to provide the Services or for other legitimate business purposes, unless applicable law requires we either dispose of it or keep it longer. We may also continue to store your Personal Information to allow us to resolve disputes, enforce our agreements, comply with legal obligations and/or for other legally permissible purposes consistent with this Privacy Notice.

WHAT ABOUT INFORMATION OF CHILDREN?

Torrent Ammunition does not knowingly collect any Personal Information from children under the age of 18. If we discover we have received any Personal Information from a child under the age of 18, we will take reasonable steps to delete that information as quickly as possible. HOW DO WE SECURE YOUR PERSONAL INFORMATION?

We use commercially reasonable measures to help protect your Personal Information from loss, theft, misuse and unauthorized access, disclosure and alteration. While these measures help ensure your data is safe and secure, please be aware no service over the Internet or wireless networks is completely secure against hacks, intrusions, attacks, or other unauthorized access. We cannot guarantee none of these events will occur, so please take care in deciding what information you provide to us.

WHAT CHOICES DO YOU HAVE REGARDING YOUR INFORMATION?

Account Information

You may update, correct, or delete information about you at any time by logging into your online account or emailing us at [email protected]. If you wish to delete or deactivate your account, please email us at [email protected], but note that we may retain certain information as required by law or for legitimate business purposes.  We may also retain cached or archived copies of information about you for a certain period of time.

Cookies

Most web browsers are set to accept cookies by default.  If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services or to complete transactions on our website.

Promotional Communications

You may opt out of receiving promotional emails or promotional texts from Torrent Ammunition by following the instructions in those or contacting Customer Service at [email protected].  If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations, such as fulfilling pending orders, policy updates or responding to customer service related requests.

Your California Privacy Rights

Requests to Access or Delete your Personal Information: Pursuant to the California Consumer Privacy Act, Customers in California may request the deletion of, or access to, their personal data. To protect your data from unauthorized access, Torrent Ammunition requires third party verification of your identity before deleting or granting access to your personal data. To request access or deletion, please scan or take a photo of your state issued driver’s license or identification and upload this in the Licenses and Documents section of your account homepage, then submit your request through the Contact Us page using the email function, with the “Print or Delete Privacy Act Eligible Data” reason for your request, or by phoning our Customer Support team. In accordance with the California Consumer Privacy Act, information collected solely for the purposes of legal and regulatory compliance will not be disclosed. Exercising these rights will not create discriminatory behavior by Torrent Ammunition.  Torrent Ammunition does not sell your personal information.
